Welcome to Anxious & Pawsitive! The terms "we", "us" and "our" refer to Anxious & Pawsitive. We run this store and website, including all related information, content, features, tools, products and services to bring you a curated shopping experience (the "Services"). We're powered by Shopify, which enables us to do what we do.
The below terms and conditions, together with any policies referenced herein (these "Terms of Service" or "Terms"), describe your rights and responsibilities when you use the Services.
Please read these Terms carefully — they cover important stuff like warranty disclaimers and limitations of liability. We've tried to keep it as human as possible, but it's still a legal document, so take your time.
By visiting, interacting with or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you don't agree, that's okay — but please don't use our Services.
SECTION 1 — ACCESS AND ACCOUNT
By agreeing to these Terms, you represent that you are at least the age of majority in your state or province of residence, and you've given us your consent to allow any of your minor dependents to use the Services on devices you own, purchase or manage.
To use the Services — browsing our store or buying anything — you may be asked to provide certain information like your email address, billing, payment and shipping info. You represent and warrant that all the information you give us is correct, current and complete, and that you have all rights necessary to provide it.
You're solely responsible for keeping your account credentials secure and for everything that happens under your account. You may not transfer, sell, assign or license your account to anyone else.
SECTION 2 — OUR PRODUCTS
We've done our best to show our products accurately in the store. That said, colors and appearance may look slightly different depending on your device and screen settings — that's the nature of screens, not a trick on our part.
We don't warrant that the appearance or quality of any product will meet your expectations or match exactly how it looked on your screen. Every shirt is printed to order, which means each one is made fresh when you buy it — no mystery stock sitting in a warehouse for a year.
Product descriptions may change at any time without notice at our sole discretion. We reserve the right to discontinue any product at any time and may limit quantities to any person, geographic region or jurisdiction, on a case-by-case basis.
SECTION 3 — ORDERS
When you place an order, you're making us an offer to purchase. We reserve the right to accept or decline your order for any reason. Your order isn't accepted until we confirm it, and we need to receive and process your payment first. Please review your order carefully before submitting — because we start printing quickly, we may not be able to cancel after acceptance. If we don't accept, change or cancel an order, we'll try to let you know using the email, billing address or phone number you provided.
Your purchases are subject to return or exchange only in accordance with our Refund Policy.
You represent and warrant that your purchases are for your own personal or household use, not for commercial resale or export.
SECTION 4 — PRICES AND BILLING
Prices, discounts and promotions may change without notice. The price at the time you place your order is what you'll pay, and it'll be in your order confirmation email. Unless clearly stated, posted prices don't include taxes, shipping, handling, customs or import charges.
Prices online may differ from prices elsewhere. From time to time we may run promotions with separate terms. If there's a conflict between a promotion's terms and these Terms, the promotion terms win.
You agree to provide current, complete and accurate purchase, payment and account information. You'll promptly update your account — including your email address, card numbers and expiration dates — so we can complete your transactions and contact you if needed.
You represent and warrant that (i) the payment info you provide is true, correct and complete, (ii) you're authorized to use that payment method, (iii) charges will be honored, and (iv) you'll pay the charges at the posted prices, including shipping, handling and any applicable taxes.
SECTION 5 — SHIPPING AND DELIVERY
We're not liable for shipping or delivery delays. Delivery times are estimates, not guarantees. We're not responsible for delays caused by shipping carriers, customs processing or events outside our control. Once we hand your order to the carrier, title and risk of loss passes to you. SECTION 6 — INTELLECTUAL PROPERTY
Our Services — including all trademarks, brand names, text, images, graphics, product reviews, video and audio, plus the design, selection and arrangement of them — are owned by Anxious & Pawsitive, our affiliates or licensors, and are protected by applicable intellectual property laws.
These Terms let you use the Services for your personal, non-commercial use only. You may not reproduce, distribute, modify, create derivative works of, publicly display, perform, republish, download, store or transmit any of the material without our written consent. Nothing here grants you a license to any of our intellectual property. Unauthorized use may violate federal and state laws.
"Anxious & Pawsitive," our logos, product and service names, designs and slogans are our trademarks. You may not use them without our written permission. Shopify's name, logo and product names are trademarks of Shopify. Other names and logos belong to their respective owners.
SECTION 7 — OPTIONAL TOOLS
We may give you access to third-party tools as part of the Services — tools we neither monitor nor control.
You acknowledge that these tools are provided "as is" and "as available" without any warranties. We have no liability from or relating to your use of optional third-party tools.
Any use of optional tools is entirely at your own risk. Make sure you're familiar with and approve of the terms the third-party provider sets.
We may also offer new features through the Services in the future. Those will be subject to these Terms too.
SECTION 8 — THIRD-PARTY LINKS
Our Services may contain links to websites and content provided by third parties (including embedded third-party functionality). We're not responsible for reviewing or evaluating their content or accuracy. If you leave our site to visit a third-party site, you do so at your own risk.

SECTION 9 — RELATIONSHIP WITH SHOPIFY
Anxious & Pawsitive is powered by Shopify, which lets us run this store. But any sales and purchases you make here are directly with us, not Shopify. By using the Services, you acknowledge that Shopify isn't responsible for any aspect of your purchases from us — including any injury, damage or loss from products you buy. You release Shopify and its affiliates from all claims related to your transactions with us.

All personal information we collect through the Services is subject to our Privacy Policy, and some personal information may be subject to Shopify's Privacy Policy. By using the Services, you confirm you've read these policies.
Because the Services are hosted by Shopify, Shopify collects and processes personal information about your access and use in order to provide and improve the Services. You represent that (i) you own or have all necessary rights to the Feedback, (ii) you've disclosed any compensation or incentives tied to your Feedback, and (iii) your Feedback complies with these Terms. We're under no obligation to keep your Feedback confidential, pay you for it, or respond to it.
We may — but don't have to — monitor, edit or remove Feedback we consider unlawful, offensive, threatening, libelous, defamatory, pornographic, obscene, or that violates anyone's intellectual property or these Terms.
Your Feedback must not violate anyone else's rights. No libel, no viruses, no malware. Don't use a fake email, pretend to be someone else, or mislead us about the origin of your Feedback. You're solely responsible for what you post.
SECTION 12 — ERRORS, INACCURACIES AND OMISSIONS
Occasionally there may be info on the Services that contains typographical errors, inaccuracies or omissions — relating to product descriptions, pricing, promotions, offers, shipping charges, transit times or availability. We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if anything is inaccurate at any time without prior notice (even after you've submitted your order).

Also, don't: upload viruses or malicious code, copy or exploit any part of the Services, collect others' personal info, spam or scrape, or tamper with security features. We can suspend or terminate your account at any time if we think you've violated these Terms.

We may terminate this agreement or your access to the Services at any time without notice. You'll remain liable for any amounts due up to the date of termination. Sections that by their nature should survive termination — like Intellectual Property, Feedback, Disclaimer of Warranties, and others — will continue to apply.

The information on the Services is for general purposes only. We don't guarantee its accuracy, completeness or usefulness. Any reliance you place on it is at your own risk.

TO THE FULLEST EXTENT PERMITTED BY LAW, ANXIOUS & PAWSITIVE, OUR PARTNERS, DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, SERVICE PROVIDERS OR LICENSORS, AND THOSE OF SHOPIFY AND ITS AFFILIATES, WON'T BE LIABLE FOR ANY INJURY, LOSS, CLAIM, OR ANY DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL OR CONSEQUENTIAL DAMAGES — INCLUDING LOST PROFITS, LOST REVENUE, LOST SAVINGS, LOSS OF DATA, REPLACEMENT COSTS — WHETHER BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY OR OTHERWISE, ARISING FROM YOUR USE OF THE SERVICES OR ANY PRODUCTS YOU BUY, EVEN IF WE WERE ADVISED OF THE POSSIBILITY.
SECTION 17 — INDEMNIFICATION
You agree to indemnify, defend and hold harmless Anxious & Pawsitive, Shopify, and our affiliates, partners, officers, directors, employees, agents, contractors, licensors and service providers from any losses, damages, liabilities or claims — including reasonable attorneys' fees — from third parties due to (1) your breach of these Terms, (2) your violation of any law or someone else's rights, or (3) your access to and use of the Services.
We'll notify you of any indemnifiable claim. We may control the defense and settlement at your expense, but won't settle for anything that requires non-monetary obligations from you without your okay. You'll cooperate in the defense, including by providing relevant documents.
SECTION 18 — SEVERABILITY
If any part of these Terms is found to be unlawful, void or unenforceable, that part will be enforced to the fullest extent permitted by law, and the unenforceable bit will be removed. The rest of the Terms stay in full effect.
SECTION 19 — WAIVER; ENTIRE AGREEMENT
If we don't enforce a right or provision of these Terms, that doesn't mean we've waived it.
These Terms and any policies posted on this site constitute the entire agreement between you and us, superseding anything else — whether oral or written — that came before.
Any ambiguities in interpreting these Terms won't be held against the party that drafted them.
SECTION 20 — ASSIGNMENT
You may not transfer or assign this agreement or any of your rights under these Terms without our written consent. Any attempt to do so is void. We may transfer, assign or delegate these Terms and our rights without your consent or notice.
SECTION 21 — GOVERNING LAW
These Terms and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of the Malaysia. You and Anxious & Pawsitive consent to venue and personal jurisdiction in the courts of Malaysia.

The headings in this agreement are for convenience only and won't limit or affect these Terms.

You can always view the most current version of these Terms on this page.
We may update, change or replace any part of these Terms by posting updates to our website. It's your responsibility to check back periodically. We'll notify you of material changes as required by law. Your continued use of the Services after changes are posted means you accept the new Terms.
